Who defines the terms of each license? 

While we provide suggested guidelines, the buyer and seller ultimately agree on the terms of each license.  Ishlab offers many methods of deriving a license and will do its best to guide you through the license creation process.  Ultimately, the user has full control over the terms of the license.

Who decides how much my work is worth?

Ishlab provides guidance by providing a "suggested" price point for the content based on the licensing usage selected.  The suggested price is based on our ongoing pricing surveys and industry standards.
The content owner can change the suggested price at will and at any time prior to licensing.  Once the content is licensed, the content provider will complete the transaction through the IshTec payment process.
The buyer and seller come to an agreement on the parameters of the license.  The IshTec system will still manage, track and store the license, rights and permissions and pricing generation as well as the licensing history even if we do not complete the e-commerce transaction.

Once a license is sold, how do I know if the licensee is abiding by the terms?

With IshTec, you can use the content Tracker to see who is using your work.

When terms of use for content have been infringed, a IshTec user can select from any number of automated tools to resolve the unauthorized use.  These tools range from offering the opportunity to license the content to requesting a link back to the content owner's site, inserting the content owner's ad feed, sharing ad revenues or issuing a takedown request.  Content Tracker continues to track when corrective action is taken and reports activity related to the content back to the owner.

Is the IshTec licensing agreement legally binding?

Is the IshTec licensing agreement legally binding?
Yes.  An IshTec licensing agreement is legally binding for the length of the term of the license as defined by the customer and agreed to by the content provider.

How are royalties collected and distributed?

The content provider reviews the royalty arrangements for each license prior to the completion of the transaction.  Once the transaction is executed, the royalty payment records are automatically generated for each royalty participant.  When payment of licensing fees is received, royalty records are marked as ready for distribution.

Does IshTec allow me to track every stage of a transaction?

IshTec empowers you to review transaction histories and review the progress of a transaction at every stage.

  • A full transaction and rights history can be reviewed by date range or by content item or group
  • All invoices and payments are available for review at any time by transaction stage, date range, licensee or content item or group
  • All royalty transactions are stored and available for review. Royalty transactions can be accessed by the royalty process stage, date range, licensee, royalty participant and content item or group

If I use IshTec, how will I know when someone wants to license my content?

You'll know as soon as any transaction is completed. Notification of any transaction and the invoice are sent to the content provider via email and also stored in IshTec’s database.  A content provider may use IshTec to review transaction status and history at any time

How will I know when I've received payment in exchange for a license?

Notification of payment will be sent to you via email and also stored in the IshTec database where you can view transactions and royalties at any time.

Does IshTec allow me to organize my content based on what works best for my business?

Yes.  You can organize your content by groups, making it easy for potential clients to find what they're looking for and for you to evaluate the sales and licensing performance of a specific category.

Who retains ownership? If I want to pull my content from the Internet or IshTec at any time, may I do so?

You always retain ownership of your work.  Once a piece of content is licensed, it should remain in IshTec for the term of that license unless there is a compelling circumstance to ask the licensee to cancel the license.

If the content provider decides to stop offering a piece of content for license, IshTec will reject any request to grant a new license for that content.
